1. scope

1.1 These General Terms and Conditions (GTC) apply to the implementation of retreats and other events, hereinafter referred to as Younique Retreats, organized by Burkardt, Chirinos Ruiz Rosas, Fietz GbR. Younique Retreats is the brand name under which these services are offered, regardless of the booked retreat location.

1.2 The following conditions govern the booking of the Healing Retreat.

1.3 The organizer is solely responsible for the organization and execution of the retreat and is neither a tour operator nor a travel agent.

3 Offer, Acceptance, Conclusion of Contract

3.1 The description of the retreat constitutes a legally binding offer.

3.2 The written registration or booking of a place via the online booking system by the participant constitutes acceptance of the offer and thus the conclusion of the purchase contract.

3.3 Upon acceptance of the organizer's offer by the participant's registration, the participant will receive a confirmation email. This email contains details of the order and payment as well as the order confirmation.

3.4 Participation in the retreat is at the participant's own risk. The organizer is not liable for injuries or damages resulting from the execution of exercises during the retreat, unless these injuries or damages are caused by intentional or grossly negligent conduct of the organizer.

4. storage of the contract text

4.1 The participant can view the organizer's GTC. The document can be printed and retrieved.

4.2 The contract text will be stored by the organizer and can be made accessible to the participant upon request.

5. payment of the course fee

5.1 The participant books the retreat in writing with the organizer. The purchase price is to be paid directly. The prices listed on the website are final prices and include the currently applicable VAT.

5.2 The invoice can be paid via PayPal or bank transfer.

6 Rights and Obligations of Participants

6.1 The participant is obliged to provide their personal data truthfully and completely. The participant must inform the organizer immediately of any changes to their data.

6.2 The participant is responsible for meeting the requirements for participation in the Healing Retreat at their own expense, especially booking transportation. Accommodation and meals are included in the price.

6.3 Participation in the Healing Retreat requires normal mental and physical resilience. If the participant is under medical or psychotherapeutic treatment, it is recommended to consult their doctor or therapist before participation.

6.4 The participant is responsible for the execution of the exercises at their own discretion. The organizers are not liable for incorrect executions.

6.5 The participant must inform the organizer of any physical or psychological limitations or complaints before the start of the retreat.

6.6 The participant has no claim to a specific instructor for the retreat. In the event of the unexpected absence of the announced instructor, e.g., due to illness, the organizer may provide a substitute instructor for the booked retreat. The change of instructor does not entitle the participant to withdraw from or terminate the contract.

6.7 Participation in the retreat does not replace medical or therapeutic treatment of any kind. A positive or healing effect for participants is possible and desired; however, there is no legal entitlement to it, nor is there a claim for damages in the event of a deterioration in the participant's well-being.

7 Rights and Obligations of the Organizer / Minimum Number of Participants

7.1 The scope of services provided by the organizer is limited exclusively to the execution of the retreat. The organizer does not offer travel services for arrival and departure to the retreat.

7.2 The organizer reserves the right to change the program or the content of the retreat or to omit individual elements, provided that the overall goal and character of the retreat remain unchanged.

7.3 The organizer is obliged to inform the participant no later than four weeks before the start of the retreat if it cannot take place due to the failure to reach the minimum number of participants. In this case, the paid course fee will be refunded immediately. The minimum number of participants is 4.

7.4 The organizer reserves the right to postpone or cancel the retreat in case of unforeseen events such as pandemics, natural disasters, or other force majeure events. In these cases, the paid course fee will be refunded immediately. No further claims from participants will be recognized.

7.5 The organizer is not obliged to reimburse the participant for cancellation or rebooking costs for other already booked transportation and hotel services.

8. no right of withdrawl for retreats

8.1 Participants have no right of withdrawal for the booked retreats, as these are services provided in the context of leisure activities with a fixed date.

9 Cancellation by Participants - Cancellation Fees

9.1 In the event of a cancellation by the participant, the following cancellation fees apply:

  • Cancellation up to 30 days before the start of the retreat: 50% of the total price.

Cancellation 29 days or less before the start of the retreat: 100% of the total price.

10 Right of Withdrawal; Termination for Special Reasons

10.1 Participants may withdraw from the contract if they have a valid reason, such as illness or personal emergencies. The organizer must be notified immediately.

11. liability

11.1 The organizer is only liable for damages resulting from the injury of life, body, or health caused by intentional or negligent breach of duty by the organizer or a legal representative or agent of the organizer.

11.2 The organizer is also liable for other damages caused by intentional or grossly negligent breach of duty. Liability for slight negligence is excluded.

12 Consent to Photo and Video Recording

12.1 During the retreat, photo and video recordings may be made. The participant consents to the use of such recordings for promotional purposes. If a participant does not wish to be photographed, they must inform the organizer prior to the retreat.

13 Applicable Law, Jurisdiction

13.1 The contract is subject to the law of the Federal Republic of Germany.
